Daphne attorney Thomas Dasinger says security cameras inside the Baldwin County Courthouse could have illegally recorded private conversations with his client.
Last October, a jury found David Coombs guilty of capital murder in the robbery and death of William Grunden.
But Dasinger- who represents Coombs- is asking for a new trial. A judge will rule on the motion tomorrow.
Dasinger admits he doesn't have proof audio was recorded and used against Coombs, but tells News 5 his client deserves the benefit of the doubt.
Baldwin County District Attorney Hallie Dixon says the motion for a new trial is nothing more than the defendant's latest attempt to quote: "Avoid justice by casting baseless accusations against law enforcement and citizens."
The FBI and the U-S Attorney's Office are investigating whether the security cameras violated due process and attorney-client rights.
Judge James Reid will hear the motion for a new trial Tuesday afternoon in Bay Minette.
