Elberta homeowner will not be charged for shooting an intruder during an attempted home invasion.

Elberta Police Chief Julie Joyner says a homeowner was justified when he shot a man during an attempted home invasion and will not be charged.

James Huppart was shot by the homeowner in the chest when he entered the back door of his house. The man's wife and children were sleeping just a few feet away.

Huppart staggered out of the house and collapsed outside near the roadway. He was airlifted to a local hospital and is in critical condition tonight.

People living near the crime scene say they wouldn't hesitate to use deadly force and protect their families if confronted by an intruder.

If Huppart survives, he'll be charged with burglarly.
