Herman Thomas Appeals State Bar Decision

News Five has obtained a copy of Herman Thomas' unsigned notice of appeal faxed Friday to the Alabama Bar Association.

Thomas also electronically filed the document with the Alabama Supreme Court, according to an attorney for the state's highest court.

The notice of appeal appears to contain a typo referencing when Thomas served the document to the Bar Association. The document states the appeal was served on October 11, 2009, rather than March 12, 2010.

The Alabama State Bar tells News Five Herman Thomas faxed an unsigned notice of appeal at 3:30 this afternoon.

Tony McLain, General Counsel for the Bar Association, was not immediately available to comment on whether it will be accepted in that form.

Former Circuit Court Judge Herman Thomas has filed a notice to appeal the Alabama State Bar's decision revoking his law license, according to his attorney, Bob Clark.

Clark tells News Five Thomas drafted the notice himself.

Friday 10:00 a.m.Former Circuit Court Judge Herman Thomas has until the close of business Friday to appeal the Alabama State Bar's decision to revoke his law license.

Tony McLain, General Counsel for the Bar Association, says as of late Friday morning Thomas had not filed an appeal.

Thomas was disbarred last month on allegations that he paddled defendants in his courtroom, drafted legal documents while his license was suspended and lied in an affidavit.

The former judge, who stepped down from the Circuit Court bench in October 2007, was cleared of 2nd degree assault, sodomy and sex abuse charges in a criminal trial last October.

Thomas is still a licensed attorney in Florida, but he may not be for long. Florida is planning to file an emergency petition to suspend Thomas' Florida law license as soon as the Alabama order is finalized, according to Florida Bar Association Spokesperson Susannah Lyle.

In January, Thomas announced he is running for the Alabama Senate, challenging Sen. Vivian Davis-Figures for the District 33 seat. Figures is the mother of one of the men prosecutors say Thomas abused.
