The Mobile County District Attorney's Office expects Richard Hollingsworth to have a bond hearing Thursday.
Mobile Police have charged Hollingsworth with capital murder in the shooting death of Mobile Police Officer Brandon Sigler.
Chief Assistant District Attorney Nicki Patterson said, "We, of course, will be arguing for no bond."
Mobile Deputy Police Chief James Barber explained why.
Barber said, "When the officers did spot the vehicle he (Hollingsworth) was occupying, a short pursuit did follow and he had made certain arrangements to pack up, and he appeared to be leaving town."
Patterson said, "Capital murder in the state of Alabama carries two possible penalties: death or life in the penitentiary without the possibility of parole."
When asked if the D.A.'s Office has decided to pursue the death penalty, Patterson said, "We haven't even had a chance to look at that."
Officer Sigler was what's called a courtesy officer for the Tyler Ridge Apartments.
Courtesy officers provide security and help tenants for reduced rent.
Barber said, "Its not clear to us at this point whether he (Officer Sigler) became aware of the unruly situation or of this dispute that was occurring outside by hearing it, or whether somebody knocked on his door or if somebody contacted him by telephone. We do know that it did not go through our communication system, and, so, he was responding to it as a courtesy officer, but he was acting in his capacity as a law enforcement officer."
But as a result of the shooting, will there be any changes in police policy concerning courtesy officers?
Barber said, "No, we don't see any changes at all. What we had here was a situation that should have been easily dispersed by the officer."
For now, police officers mourn in their own special way.
Barber said, "You'll see a lot of the guys are wearing the black band across the badge that indicates a fallen officer. You also see that our flags are flying at half staff. In this case, you had an officer who dedicated his life to service."
