A Daphne man accused of raping and killing 21-year Brianna Parish cried in court Thursday afternoon. Troy MacDonald, charged with capital murder, wept during his preliminary hearing in Bay Minette.

"It was emotional and stressful for him," says J. Clark Stankowksi, Troy MacDonald's attorney. "Any human in a situation like that with the guards around him and all the people, it's emotional."

"I've seen some people cry just for the television cameras," says Baldwin County District Attorney Judy Newcomb.

During the preliminary hearing, prosecutors outlined detailed information about what they say happened the night Parish went missing. Prosecutors say Parish was raped, sodomized then strangled to death. The district attorney's office also says Parish was beaten over the head with an object.

Judge Jody Bishop found enough evidence to send the capital murder case to a grand jury. The next grand jury in Baldwin County will convene in February.

Brianna Parish went missing from a Daphne bar the week before December. A volunteer search party found the young woman's body near a sewage treatment plant three days later. In December, Troy MacDonald was arrested and charged with capital murder.
