BIRMINGHAM, Ala. (AP) - A judge in Birmingham has scheduled a
hearing for early next year to consider claims by Alabama death row
inmate Tommy Arthur that he is innocent in a 1982 murder case from
Colbert County.
Circuit Judge Teresa Pulliam has scheduled a hearing for Arthur
for Feb. 17. He has already escaped three separate execution dates,
most recently in July.
Arthur's lawyer says a confession by another inmate proves
Arthur wasn't to blame for the murder of Muscle Shoals businessman
Troy Wicker. The defense also contends DNA evidence will prove his
innocence.
The state argues that Arthur is guilty and should be put to
death.
