Scrushy Wants Case Overturned

Only a couple months after former Alabama Governor Don Siegelman was released from prison, former Healthsouth CEO Richard Scrushy has asked a federal appeals court to take a look as his conviction as well.

MONTGOMERY, Ala. (AP) - Former HealthSouth CEO Richard Scrushy
has asked a federal appeals court to overturn his conviction in a
government corruption case.
Scrushy's attorneys have filed a more than 100-page brief asking
the 11th U.S. Circuit Court of Appeals to reverse Scrushy's
conviction or order that he get a new trial. The brief filed late
Monday argues that prosecutors did not prove that Scrushy bribed
former Gov. Don Siegelman to get the governor to appoint him to a
seat on a hospital regulatory board.
The brief also argues that U.S. District Judge Mark Fuller erred
by not granting Scrushy a full hearing on charges that jurors
talked to each other about the case through e-mails in violation of
the judge's instructions.
Chief prosecutor Louis Franklin declined to comment on Scrushy's
appeal.
Scrushy was sentenced to almost seven years in prison and is
being held at a federal penetentiary in Beaumont, Texas.
