MONTGOMERY, Ala. (AP) - One day after refusing to delay the execution of Thomas Arthur, the Alabama Supreme Court has done just that.
The justices voted 5-4 for a stay pending further court
orders.
On Tuesday, Thomas' attornies sent Gov. Bob Riley and court officials an
affidavit signed by Bobby Ray Gilbert who says he killed Troy Wicker
Jr. in 1982
In his hand writen affidavit, Gilbert said he was a 17-year-old having an
affair with Wicker's wife when she hired him to kill her husband
for $2,000.
But Attorney General Troy King and the victim's wife both say
the affidavit is untrue.
Arthurs' attornies had previously asked the Alabama Supreme Court to delay his July 31 execution date to
allow time for DNA testing of evidence from his trial.
