New developments Monday in the murder case of Spanish Fort gas station owner Bobby Wilson.
The attorney representing Eric Buzbee wants to find out if DNA evidence was withheld from the grand jury that indicted Buzbee.
Eric Buzbee was indicted on two counts of Capital Murder in Wilson's death.
He has pleaded not guilty to the charges.
Eric Buzbee's attorney is John Beck.
He would not talk on camera to News 5, but did tell us he filed a motion Monday before the judge hearing the case.
Beck says he wants to find out if DNA evidence found under Bobby Wilson's fingernail was withheld from the grand jury.
Beck maintains that DNA found under Wilson's fingernail did not match that of Eric Buzbee and he doesn't believe that information was presented to the grand jury.
The grand jury indicted Buzbee January 31.
Beck says he wants to see grand jury transcripts and notes.
News 5 has not been able to talk to Baldwin County District Attorney Judy Newcomb or family members of either Wilson or Buzbee.
Newcomb had said in the past, the case will be presented to a jury who will make the ultimate decision, and that's where her office plans to try the case.
Bobby Wilson died in December from injuries he received after being beaten and robbed at his service station last summer.
