Mobile police say the accidental shooting death of a 14-year-old boy was not accidental after all. Charges have now been upgraded to murder.

14-year-old Nubian James was shot in the head December 8th at a home on Woodlawn Drive South. James was transported to USA Medical Center where he died Thursday night.

Homicide investigators originally thought James and two other teenagers were playing with a gun when it accidentally went off. A 15-year-old was charged with assault and those charges were upgraded to manslaughter when James died.

Police now say the 15-year-old intentionally shot James and have charged him with murder.

Williamson High School, where James was an honor student, is holding a memorial in his honor Tuesday morning.
