Hung Jury In Carr Brother Bank Robbery Trial

Even if the state decides not to retry this case, Brandon Carr is still not a free man. He faces federal charges in the bank robbery. He's also accused of pulling off two other heists with his brothers.

The jury couldn't reach a verdict so the judge has declared a mistrial.

Brandon Carr is accused robbing the Wachovia Bank in downtown Mobile back in May of 2007. But after deliberating for three hours this afternoon, jurors couldn't agree on Carr's guilt or innocence.

The judge will wait about a week to find out if the prosecution will retry the case. Even if the state drops its case, Carr still faces federal charges. He was indicted by a federal grand jury in June.

Carr was out on bond for the bank robbery when police say he and his brother Anthomas robbed the CVS on Dauphin Street in April. But their mother claims her sons were at home eating ice cream at the time of the robbery.

The Carr's younger brother, Ian, was sentenced in June to 20 years in prison for robbing the Carmike 10 Theater two years ago. Brandon Carr is also a suspect in that heist.
